1. Who we are
Ember (the "Service") is operated by Bellview Fitness ("we", "us", "our"). By creating an account or using the Service, you ("you", "user") agree to these Terms.
2. Acceptance
By continuing to use the Service you agree to be bound by these Terms. If you do not agree, do not use the Service. You must be of legal age to enter into this agreement.
3. The Service
Ember provides cycle-tracking insights, communication suggestions, an AI advisor, and self-regulation tools intended for personal, non-clinical use. The Service is not a substitute for medical, psychological, or relationship advice.
4. Acceptable use
You must not misuse the Service. You agree not to:
- Use the Service for unlawful, fraudulent, or abusive purposes;
- Infringe the intellectual property or privacy of others;
- Attempt to probe, scan, scrape, reverse-engineer or interfere with the Service or its security;
- Upload malware or send spam;
- Use AI features to generate illegal content, harassment, deepfakes, or content that violates third-party rights;
- Rely on AI outputs as professional advice — you are responsible for verifying outputs and how you use them.
5. Account
You must provide accurate information and keep your credentials confidential. You are responsible for activity under your account.
6. Intellectual property
Ember, including its software, content, design, and branding, is owned by Bellview Fitness and protected by intellectual property law. We grant you a limited, non-exclusive, non-transferable right to use the Service within your chosen plan. You may not resell, sublicense, or redistribute the Service.
7. Payments and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation and refund mechanics are governed by the Paddle Buyer Terms in addition to these Terms.
Subscriptions renew automatically at the end of each billing period until cancelled. You may cancel at any time; access continues through the end of the paid period.
8. Service availability
We do not guarantee that the Service will be uninterrupted, error-free, or always available. We may modify, suspend, or discontinue features at any time.
9. Suspension and termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. On termination, your right to use the Service ends; we may delete your data after a reasonable window.
10. Warranties and liability
To the fullest extent permitted by law, the Service is provided "as is" without warranties of any kind. Our aggregate liability is limited to the fees you paid to us in the 12 months preceding the claim. We are not liable for indirect, consequential, or special damages including loss of profits, data, or goodwill. Nothing limits liability for fraud, death, or personal injury where prohibited by law.
11. Governing law
These Terms are governed by the laws applicable to Bellview Fitness's place of business. Disputes will be resolved in the competent courts of that jurisdiction.
